    Refund Policy

    How donation refunds work on Givelayer.

    This Refund Policy explains how donation refunds are handled on the Givelayer platform. It is incorporated into the Givelayer Terms of Service.

    Overview

    Donations made through Givelayer are processed by Stripe and held in charity-controlled Stripe Connect accounts. Refunds are issued by the receiving charity, not by Givelayer. This Policy explains how donors can request refunds, how charities are expected to handle them, and what role Givelayer plays in the process.

    Refund Window

    Donors may request a refund within 30 days of the donation date.

    From the donation date, donors may request a full refund through the receiving charity.

    Refund requests submitted after 30 days will be considered at the receiving charity's sole discretion. Some charities may grant refunds beyond the 30-day window in cases of duplicate donations, unauthorized transactions, or other extenuating circumstances.

    How to Request a Refund

    3.1 Contact the Charity Directly

    To request a refund, donors should contact the receiving charity directly. Charity contact information is provided on:

    • The donation receipt sent to the donor
    • The charity's Givelayer donation page
    • Any communication received from the charity

    3.2 Information to Include

    When requesting a refund, please provide:

    • Full name on the donation
    • Email address used at checkout
    • Date and amount of the donation
    • Reason for the refund request
    • Any reference number from the receipt

    3.3 Charity Response Time

    Charities are required to respond to legitimate refund requests within 14 business days.

    Charities must respond to legitimate refund requests within this window. If they don't, donors can escalate to Givelayer.

    3.4 Escalation to Givelayer

    If the receiving charity does not respond within 14 business days, donors may escalate the request to:

    support@givelayer.com

    Givelayer will:

    • Contact the charity on the donor's behalf
    • Investigate the request
    • At our discretion, intervene to facilitate the refund where appropriate

    Eligible Refund Reasons

    Charities are expected to grant refunds in cases including:

    • Duplicate donations (e.g., the donor was charged twice for the same gift)
    • Unauthorized transactions (e.g., donations made using a stolen payment method)
    • Donor error (e.g., incorrect amount entered)
    • Donations made under fraudulent solicitation
    • Other circumstances where refusing the refund would be unreasonable

    Charities retain discretion to deny refunds for reasons such as:

    • The donation has already been allocated to a specific program or campaign that has been completed
    • The refund window of 30 days has passed
    • The donation was made with full knowledge of the charity's mission and use of funds

    How Refunds Are Processed

    5.1 Source of Refunds

    Refunds are processed from the receiving charity's Stripe Connect account balance. If the charity's balance is insufficient to cover the refund, the refund amount may be deducted from the charity's next scheduled payout.

    5.2 Refund Method

    Refunds are issued to the original payment method used for the donation. Processing time varies by payment method:

    • Credit and debit cards: 5–10 business days to appear on the donor's statement
    • Bank transfers: 3–7 business days
    • Other payment methods: Varies by provider

    5.3 Refund Confirmation

    Donors will receive an email confirmation when the refund is initiated by the charity. The confirmation includes the refund amount, processing time, and any relevant reference numbers.

    Non-Refundable Items

    The following are non-refundable except where required by applicable law:

    6.1 Givelayer Tips

    Tips paid by donors to Givelayer at checkout (separate from the donation to the charity) are non-refundable. Tips support platform operations and are clearly disclosed and adjustable at the time of donation.

    6.2 Platform Fees

    The 2% Givelayer platform fee deducted from donations (when not covered by a donor tip) is non-refundable.

    6.3 Stripe Processing Fees

    Stripe may, at its sole discretion, refund processing fees in limited circumstances. Givelayer does not control Stripe's fee refund policy.

    Tax Receipt Implications

    When a donation is refunded:

    • (a)The original tax receipt is no longer valid;
    • (b)The receiving charity is responsible for issuing a corrected receipt or notifying the donor that the receipt should be disregarded;
    • (c)Donors should not claim refunded donations on their tax returns;
    • (d)Donors who have already filed taxes with the original receipt may need to file an adjustment with their tax authority.

    Givelayer's role in receipt corrections is limited to providing technology support to the charity. The charity is the legal issuer of all receipts.

    Chargebacks

    A chargeback is a forced refund initiated by a donor through their card issuer or bank, typically for fraud or unauthorized transactions.

    8.1 Charity Liability

    Charities are responsible for all chargebacks filed on donations received through the Service. Chargeback fees imposed by Stripe or card networks are deducted from the charity's Stripe account balance.

    8.2 Excessive Chargebacks

    Charities with chargeback rates exceeding industry thresholds may be:

    • Subject to enhanced monitoring
    • Required to provide additional documentation or security deposits
    • Suspended pending investigation
    • Terminated from the Service

    8.3 Disputing Chargebacks

    Charities may dispute chargebacks through Stripe's dispute resolution process. Givelayer can provide technical support but does not represent charities in chargeback disputes.

    Refunds Initiated by Givelayer

    In limited circumstances, Givelayer may initiate refunds without the receiving charity's consent, including:

    • When a charity violates the Terms of Service or Acceptable Use Policy
    • When a charity loses charitable status
    • When fraud is suspected or confirmed
    • When required by law or regulator order
    • When a charity fails to respond to legitimate refund requests after reasonable attempts to contact them

    Refunds initiated by Givelayer are deducted from the charity's Stripe account balance. If the balance is insufficient, the deficit may be recoverable from the charity through legal action.

    Donor Disputes with Charities

    Givelayer is a technology platform connecting donors and charities. We are not a party to the donation transaction itself. Disputes regarding the use of donated funds, charity performance, or charitable purpose are between the donor and the charity.

    We encourage donors with concerns to:

    • (a)Contact the charity directly;
    • (b)Report concerns about charity misconduct to:
    • United States: State Attorney General's Office or IRS Charities Division (irs.gov/charities)
    • (c)Report Givelayer-specific concerns to support@givelayer.com.

    International Donations

    Refunds for international donations follow the same procedures, but processing times may be longer due to international banking systems. Currency conversion may result in slight differences between the original donation amount and the refund amount due to exchange rate fluctuations.

    Changes to This Policy

    Givelayer may update this Refund Policy from time to time. Material changes will be communicated through the Service or by email. Continued use of the Service after the effective date of an update constitutes acceptance.
